Terms of Service (English)

Article 1 (Introduction)

Viblo is the product provided by Sun Inc*. Viblo is a platform to promote technical sharing, as well as connect the Vietnamese IT-Engineer community to improve their technical capabilities.

  1. The following is "Terms of Service". Using Viblo means Users agree to these Terms and Conditions of Service Usage (below referred to " Terms of Service").

  2. These Terms of Service are the conditions relating to the use of Viblo (below referred to "This Service"), a product provided by Sun* Inc (below referred to "Our Company"). It defines the relationship between customers using the service (below referred to "Users") with the Company.

  3. By using Viblo, you accept our Terms of Service and agree to abide by them.

  4. Our Company reserves the right to update the Terms of Service without notice to Users. The latest version of these Terms of Service is preferably applied to all earlier versions; and the published terms are currently valid.

Article 2 (Service Registration)

  1. Access to This Service is only available to registered users (below referred “People who want to use This Service”), so a person who would like to use the Service must choose an Viblo ID (below referred “User ID”) and a Password to register an account.

  2. People who want to use This Service while registering must provide some information required by Our Company. Users must agree with the below conditions related to Users’ personal profile.

  3. After registering your personal profile, User must ensure that your personal profile is always completed, accurate and up-to-date. If there is any change about users’ information, Users must proceed to adjust those in their own account provided by This Service. If users’ personal information is not accurate, we reserve the right to disallow or suspend Users’ access without any prior notice.

  4. If Users’ access is disallowed in This Service but that User ID is still used in other services offered by Our Company, Users’ access in those services will be canceled as well.

Article 3 (Definitions of Users and Registration)

  1. This Service’s Users are defined as Registered users and Visitors.

  2. Registered users are users who have filled in the required information form for registration and got acceptance from Our Company.

  3. Registered users also are users using external authentication services accepted by Our Company such as: Facebook, Google, Github…

  4. Visitors are users who just view, or have not done any registration process as mentioned above, or they just use permitted services.

Article 4 (Username and Password)

  1. Registered users will get their own account with an ID and password to sign in. Users will be responsible to manage their own ID and password.

  2. The sign-in process by User ID and password is regarded to be done by that ID's owner.

  3. Each registered user just possesses only one account, except for some special cases accepted by Our Company.

  4. To get an User ID and password, the email address and profile must be accurate and legal.

  5. Users are entirely responsible for maintaining the confidentiality of their own accounts and passwords, and may not lend or transfer in any manner.

  6. If User ID or password is lost or stolen, or if you believe that your account has been accessed by unauthorized third parties, Users are advised to notify Our Company immediately. We will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge.

  7. If Users register their accounts in This Service by external services’ ID, all terms related to ID registration and other requirements of those external services must be subjected to all the rules obligated by those. Our Company will not take any responsibility for that.

Article 5 (Cancellation of User Status)

  1. In these following but not limited below cases, following Our Company's review, User status may be revoked:

(1) Registered information is not accurate.

(2) User ID and password are used wrongfully.

(3) Using information provided by This Service, along with external services wrongfully.

(4) Using User’s ID and password, which were rejected, for other services’ registration provided by Our Company.

(5) Have any action in contrast to these Terms of Service.

(6) Besides, when Our Company found that User is not suitable to use This Service

  1. If User Status is disallowed in this Service but that User ID is still used in other services offered by Our Company, then the status in those services will be rejected as well.

Article 6 (Privacy)

In providing This Service, Our Company needs to obtain little information from Users. Our Company always focuses as much as possible on protecting Users’ personal information collected from Users.

Article 7 (Prohibitions)

1. While using This Service, Users are not allowed to take these following but not limited illegal acts:

(1) The act of infringing upon the intellectual property rights of copyrights, patent rights...

(2) The act that invades personal privacy.

(3) The act of defamation, libel of others’ honor, or the act of obstructing others’ work.

(4) The act of deceptive behavior.

(5) And other criminal acts, or acts contrary to the provisions of the law.

2. While using This Service, Users are not allowed to take these following but not limited acts inconsistent with social rules:

(1) The act that foretells a crime, conduct that leads to a crime, or actions that are likely to lead to a crime.

(2) The act of discrimination on race, ethnicity, creed, gender, social background, place of residence, physical characteristics, illness, education, property or income...

(3) The act against the State of the Socialist Republic of Vietnam; causing harm to national security, social order and safety; undermining the great unity block of the citizens; propaganda wars of aggression and terrorism; causing hatred and conflict among peoples, ethnicities, races, religions...

(4) The act of propagating, inciting violence, lewdness, debauchery, crimes, social evils, superstition, destruction of the nation's fine customs and traditions, aggravate viewers.

(5) The act of disclosing state secrets, military secrets, security, economic, foreign affairs and other secrets prescribed by law in any forms on Viblo social network.

(6) The act of causing trouble, discomfort to others, or defamatory of others. The act that causes mental or economic harm to other people without proper rights.

(7) The act of using the name of another person, or of another company or entity without permission, using an unrealized personal name, company name, or association, or pretending to have a partnership relationship with another person, company, or entity.

(8) The act of impersonating others to use the service, distorting information.

(9) Other acts contrary to social morality and public order.

(10) The act of defaming or defaming opponents, other organizations or individuals.

(11) The act of organizing games, giving gifts without prior notice or approval from This Service.

3. While using This Service, Users are not allowed to take these following but not limited acts that are not suitable for the use of This Service:

(1) The act of advertising, propaganda for commercial purposes. However, it’s allowed in some special cases authorized by Our Company.

(2) The act of sharing User IDs. In which, a person owns more than one account without Our Company's permission, or one person owns more accounts than the number accepted by Our Company. Both are considered inappropriate behaviors for the use of This Service.

(3) The act of using User IDs which are offensive and misleading to others. The use of User IDs that are the same, or close to, the names of well-known companies, groups or products known by Our Company or by others.

(4) The act of collecting, stealing, storing, modifying or using personal information. The act of illegally changing personal information and user information.

(5) The act of hiding the basic components of the service such as Header, Footer, Advertising, or Copyright symbols... without Our Company's permission.

(6) The act of trading, transferring services without Our Company's approval.

4. While using This Service, Users are not allowed to take these following but not limited acts of creating content that are not in accordance with our regulations:

  • About articles posted by Users:

(1) The article is too short (under 150 words / 1000 characters including spaces) or contains only exclamatory words: crazy, mad, bored, yes, uh, agree,...

(2) The article contains only emoji or the number of emoticon characters is more than that of text characters.

(3) The article on the same topic/content with other articles of the author or with other articles published on Viblo (even in the case of using multiple accounts to submit and be different from forms and titles, but being concluded the same content by the Administration after reviewing)

(4) The article has indeterminate content, makes no sense or does not describe what to aim for.

(5) The article with content unrelated to the title and vice versa, or just promotional content.

(6) The article with content or URL links that are promotional or commercial, repetitive, irrelevant, or overly verbose.

(7) The article has non-IT-related content, does not convey valuable information and contributes to the Vietnamese IT community.

(8) The article uses a lot of slang words, words, images that are offensive and inappropriate.

(9) The article has signs of copying, plagiarism, and quoting the source without the author’s permission for that content. After reviewing by the Administration, if the volume of content with signs of copying exceeds 20% of the total article, that article will be considered as “Spam”.

  • About question posted by Users:

(1) The question only includes emoticons, or the number of emoticon characters is more than that of text characters.

(2) The question with unknown, non-IT related content (e.g. advertising, commercial, etc.)

(3) The question that incite, promote violence, attack another individual or organization.

(4) The question is not valuable to learn, exchange knowledge with each other or build and develop positively for the community.

  • About answers, comments posted by users:

(1) The comment/answer is too short, less than 15 characters, or only include emoticons.

(2) The comment/answer off topic, interrupting discussion.

(3) The comment/answer with duplicate content in the same topic.

(4) The comment/answer that is offensive to individuals and organizations, and using language that is not suitable.

Apart from what is listed above, Users are not permitted to take any actions which Our Company considers inappropriate.

Article 8 (Penalizing of account and content violation)

  1. Regulations on handling of violations are specified in Article 7 above:

Temporarily ban that account for 3 days, 1 week, 2 weeks, 1 month or permanently delete the account depending on the severity of the behavior. The Administration reserves the right to review and make enforcement decisions on accounts without prior notice.

  1. Regulations on handling of Spam Articles/Questions/Comments/Answers:

(1) After receiving a Spam notification, the account will receive a request to edit the article for re-evaluate.

(2) If after updating, the article fully meets the requirements and does not violate the regulations of This Service, the article will be removed from Spam status and posted publicly on Viblo.

(3) If the account refuses to edit the article or after editing, it is still not in accordance with the rules of This Service, after 30 days from the first time the article is published, the article will be removed on Viblo. From now on, the account can no longer edit posts.

(4) For questions/comments/answers that violate Spam regulations, the Administration will delete them without prior notice.

(5) In some cases, an account that violates Spam regulations too many times or has actions which go against Viblo community's regulations will be temporarily or permanently banned.

Article 9 (Handling of Contents Posted by Users)

  1. Users must ensure and demonstrate clearly that the data in text such as posts, comments, public personal information, or personal introduction, or the data attached to the text such as images, audio files, video (below referred as “The Content”) which is self-uploaded is legal rights with Users, and not limited to infringe the rights of third people or parties.

  2. Users authorize Our Company to reserve the right to use The Content (for processing, storing, editing, authorizing to third parties or the right to other users...). The scope of giving Our Company the right to use The Content including that Our Company allows other users to use The Content via This Service. In particular, The Content relating to programming, such as source code which is uploaded by Users, are allowed to be used by other users, regardless of whether it is related to trade or not, and any users may use it. Therefore, Users can use the methods which are defined by Our Company for editing, restoration The Content of other users. In case of source code written clearly with the License, it is required to comply with the content of this license.

  3. Regarding the using authority mentioned in the previous section, if there’s no problem in copyright displaying duty or associated conditions or the limitations on geographic location, the right of use which the user assigned to Our Company is extended the deadline until Users have been removed from using This Service, and valid as long as the ownership of intellectual property the post is maintained.

  4. Our Company or a third-party which Our Company entrusted can put The Content on the website of Our Company or third parties. In that case we will be able to perform some actions such as abstracting, citations, resizing, or removing parts of The Content. In addition, Users also recognize that in case we use The Content, we may show the user ID, or the registration information of Users at the time Users upload the posts.

  5. Our Company is not completely responsible for the damages incurred for Users during the process the company, other users, or third party uses the posts.

  6. Our Company has the right of freedom to store The Content. In case of need, we do not need posters’ agreement but can still edit or delete The Content. Users will not have any complaints about this issue.

Article 10 (Handling of Users Information)

About the information inputted by Users during registration, but have no effect in determining who the user is, based on Our Company decision, we can be free to use or display to third parties.

Article 11 (External Services)

  1. This Service can be connected with other external services such as Facebook, GitHub, but Users must take their own responsibility for using them. We will not be responsible for any circumstances that occurred to Users while using those services.

  2. Users using external services must comply with their rules of use.

  3. Users agree that under agreement, the published articles or other sharing information will be posted to the external services. Moreover, we are not obligated to delete the post which is posted to the external services.

Article 12 (Changing or Termination of Service)

  1. Users must agree that Our Company can change the contents of the service without prior notice to users. We will also not take any responsibility for the changes, in case those bring some inconvenience or affect to users, and we hope Users be sympathetic to these changes.

  2. Our Company may suspend or cancel the service after notice to the user at least 10 days in advance. The suspension, or cancellation of service is noticed on this website, and after taking the procedure. In the case we pause or cancel the service, we will absolutely not assume any liability for compensation to Users.

Article 13 (Termination of Service from Users)

For any reasons, Users have the right to stop using This Service. In that case, Users must follow the offered procedures to notify us.

Article 14 (Handling after Ending the Contract)

Our Company has the right to use the content of the posts along with Users’ registered information, and the article 9 and 10 above remain their effects even if Users’ status is canceled for any reasons, or Users cancel the use of This Service.

Article 15 (Questionnaire)

Our Company may send the survey to Users via email. In addition, we have the right to send to Users (including external links) some advertising information or products and services provided by third parties (called [additional information]). Further, these supplementary information exchanges are carried out based on Users’ responsibility. We have no obligation to be responsible for the exchanges with Users, based on the contents of the additional information.

Article 16 (Analysis and Advertisement)

  1. Our Company collects anonymous usage information based on the cookies to research trends of users’ activity on the service.

  2. Our Company may accept to display advertisements based on the provisions of each part of this Terms of Service and Users will have to accept this before using This Service.

Article 17 (Ownership and copyright)

  1. Users retain their ownership of all self-posted content on our services.

  2. Users also agree and undertake to be responsible for copyright issues to self-posted content on our services.

  3. We retain the ownership of the software, service, and information in This Service. If there’s no other agreements in text, email, or through the service functions, Users agree to give us the right to distribute, modify, adjust, publish, build upon their content, free of copyright charge, and be used for any purposes.

  4. All softwares used by This Service including trade secrets and property rights is protected by laws related to intellectual property rights.

Article 18 (Refusal of Responsibility)

  1. Users must explicitly agree to use This Service based on their own responsibility. We offer This Service to the conditions [the scope may apply] and [actual circumstances]

  2. Our Company is absolutely not responsible for the content below: (1) The contents of This Service bring benefits or meet the demand of Users.

(2) The accuracy and appropriateness of Users’ articles posted on This Service.

(3) The interruption, suspension or cancellation of This Service.

(4) This Service is provided on time.

(5) The safety of services.

(6) There will not be any errors generated in This Service.

(7) The information collected from users of this service is accurate, legal, suitable with the habits and customs, ensuring the latest, and appropriateness or can be trusted.

(8) The services may be flawed.

(9) The action that Users use the service to meet their personal purposes.

(10) There is no loss on the post content or information posted by registered Users through This Service.

  1. Our Company is not responsible for any problems when Users use This Service with their personal responsibilities that have arisen out of or related to the loss of data on the communication devices such as computers, mobile phones, tablets,...

  2. Our Company is not responsible for the action of Users using This Service to serve their specific purpose (including commercial purposes as well as other purposes) or not.

  3. Our Company is not responsible for transactions involving This Service or This Service’s Users or goods which are collected or bought by using the functionality of This Service.

Article 19 (Changing Terms)

These Terms of Service may be updated depending on Our Company’s situation. If there are any updates to these Terms of Service, we will notify Users on this website or in other ways.

After our notification, if Users still use this Service or do not stop using the service, it is concluded that Users agree with those updates.

Article 20 (Appendix)

The effect of this terms & conditions is applied from the moment which This Service is officially in use.

Users who have agreed to the terms & conditions are deemed to have agreed to the terms before.
